1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Cloudcraft LLC., doing business as Prolocaler (“we,” “us,” or “our”), concerning your access to and use of the Prolocaler website and marketplace application.
2. Description of the Marketplace
Prolocaler is an online marketplace and booking platform that connects independent service providers (“Providers”) with clients seeking professional local services (“Customers”). Prolocaler does not directly provide the underlying physical or professional services; Providers operate as independent contractors and are solely responsible for the performance, quality, and licensing of their offered services.
3. Payments & Billing
All payments for bookings on Prolocaler are processed securely through our third-party payment processor, Stripe, Inc. By providing a credit card, debit card, or other accepted payment method, you authorize Cloudcraft LLC / Stripe to charge the specified service fee, including any applicable taxes or processing fees, at the time of booking. All transactions are denominated in United States Dollars ($ USD).
4. Cancellations & Refunds
Cancellations and refunds are governed by our dedicated Cancellation & Refund Policy. Customers may cancel eligible appointments in accordance with the cancellation window specified at the time of booking.
5. User Conduct & Accounts
You agree to provide accurate, current, and complete registration information. You are responsible for safeguarding your password and account activities. We reserve the right to suspend or terminate accounts that engage in fraud, abuse, harassment, or unlawful activities.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Cloudcraft LLC and its affiliates, officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the platform or the services rendered by independent Providers.
7. Governing Law & Dispute Resolution
These Terms shall be governed by and defined following the laws of the State of Georgia, United States, without regard to its conflict of law principles. You irrevocably consent that the courts of Cherokee County, Georgia shall have exclusive jurisdiction over any dispute.
